Driver’s License Suspension DUI Attorney vs. Personal Injury Attorney

If you have suffered a driver’s license suspension and it has caused loss of wages or other personal harm to your life, you may wonder if you can or should hire a personal injury lawyer to help you with your defense.

The answer is yes and no. In general, a personal injury attorney is for the other party, the person whose personal property or body was harmed due to you operating a vehicle while under the influence. They are for the plantiff unless they also happen to be a DUI attorney.

When your license is suspended or revoked you will need a DUI defense attorney. They are more familiar with the laws regarding license suspension and the legal process of fighting the suspension.

But I didn’t Have a DUI, why was my license suspended?

There are several reasons this could happen. Sometimes it is simple human or computer error. A person with the same name had their license suspended or revoked. When you were pulled over, it was triggered by computer or human error. There may be other reasons, such as you had your license suspended or revoked in the past and due to human error the correct information was not put on file when it was restored.

The best idea is to go get a DMV printout of your driving record. If, on the date in question, your license was not suspended or revoked, you can present it to the prosecuting attorney and have the case dismissed. If the prosecution does not automatically dismiss the case upon your evidence, then you can present it at trial and the case will be dismissed. Normally the prosecutor will not proceed with the case upon receiving the documented proof.
